WRIT OF ARREST
REPUBLIC OF LIBERIA, TO CAPTAIN FOFIE V. KAMARA MAGISTRATE POLICE OR HIS DEPUTY, GREETINGS:
YOU ARE HEREBY COMMANDED TO ARREST THE LIVING BODY OF ALOYSIUS TOE, Defendant and forthwith bring him before the Monrovia City Court to Answer to the charge of TREASON based upon the OATH and complaint of the Republic of the Republic of Liberia in which it is substantially alleged as follows to wit:
That the Defendant in contravention of the Constitution of the Republic of Liberia as quoted below:
TREASON: ARTICLE 76 of the Liberian Constitution, January 6, 1986 says, “Treason against the Republic shall consist of :
1. Levying War against the Republic;
2. Aligning oneself with or aiding and abetting another nation or people with whom Liberia is at war or in a states of war;
3. Acts of espionage for an enemy state;
4. Attempting by overt act to overthrow the Government, rebellion against the Republic, insurrection and mutiny; and
5. Abrogating or attempting to abrogate, subverting of attempting or Conspiring to subvert the Constitution by use of force or show of force or by any other means which attempts to undermine the Constitution”
That in the year 2002, at diverse calendar Months and dates the defendant Aloysius Toe, conspired, connived, and acted in cohort with LURD-Liberian United for Reconciliation and Democracy forces to overthrow the constitutionally elected Government of Liberia by use of force and replace with an unconstitutional "Interim Government" as reflected in the proposals revealed in the E-mail.
It is further recorded that the structures of governance would be altered and the radical re-organization of security and other key components of the government would take place.
In furtherance of defendant's evil design, and following various plans and discussions with his colleagues executives of LURD, he, defendant Aloysius Toe was sent an E-Mail with captioned YAHOO Mail – aloysuistoe@yahoo.com, dated Tuesday October, 1, 2002 by the National Executive Committee, The Liberians United for Reconciliation and Democracy, LURD Voinjama, Liberia, by and thru the Office of the Political Advisor, Tel: 0031302421273 Email; Cbdennie@hotmail.com.
The aforementioned E-Mail did contain a subheading: pragmatic plan of action: Cessation OF Hostilities and Convening of National Conference For Formation of INTERIM GOVERNMENT. Defendant Toe and his collaborators, the LURD Forces have planned and are in the process of implementing their plan of action for the unconstitutional removal of His Excellency Charles G. Taylor, President of the Republic of Liberia from office after which they intend to install an Interim Government contrary to the constitution of the Republic of Liberia
It is Defendant Toe and his collaborate plan to form a government to be name and styled the Interim Government Of National Reconciliation And Reconstruction .
To further strengthen the actualization of defendant's idea the aforementioned Email containing the enumerated plan of action of LURD.
That despite the wicked and diabolical plan contained in aforesaid E-mail to overthrow the Constitutionally elected Government of the Republic of Liberia by force, the Defendant, having full knowledge thereof, did, without the fear of God, and being moved by the instigation of the devil without legal justification or excuse, unlawfully, willfully, wrongfully, intentionally, deliberately, feloniously, with premeditation and malice aforethought, did connive, conspired acting in cohort and in concert with common design did embrace and aided in the formulation of the ideas and aspirations of LURD to overthrow the government of Liberia, and for this purpose withheld the plan to unseat the Liberian government by force. Then and thereby the crime of Treason the defendant did do an commit, contrary to the form, force and effect of the Statutory Laws of Liberia, in such case made and provided and against the peace and dignity of this Republic. AND HAVE YOU THERE THIS WRIT OF ARREST.
